TurnkeyDoor LLC ("TurnkeyDoor," "we," "us," or "our") operates a real estate technology platform at turnkeydoor.com (the "Platform"). The Platform provides tools and services to assist (a) homeowners in selling their properties without a traditional listing agent (FSBO), and (b) landlords in managing rental listings, tenant screening, leases, and property compliance (FRBO), in Bergen County, New Jersey and surrounding areas.

TurnkeyDoor is a technology platform — not a licensed real estate brokerage. All MLS listings facilitated through the Platform are held by our licensed partner brokers in the State of New Jersey. TurnkeyDoor does not provide real estate brokerage services, legal advice, mortgage lending, property management services, or financial advisory services.

Commercial vs. Consumer Users. These Terms apply to all users. Where you use the Platform for commercial purposes (e.g., as a landlord listing or managing rental properties), you do so in a business-to-business capacity. Where you use the Platform as a tenant (e.g., searching for housing, submitting rental applications, or paying rent), you do so as a consumer, and all rights afforded to you under New Jersey consumer protection law — including the NJ Consumer Fraud Act (N.J.S.A. 56:8-1 et seq.) and the Truth-in-Consumer Contract Warranty and Notice Act (N.J.S.A. 56:12-14 et seq.) — are expressly preserved. Nothing in these Terms limits, waives, or restricts any right you hold under those statutes.

By accessing or using the Platform, creating an account, listing a property, or engaging with any feature of TurnkeyDoor, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the Platform.

We reserve the right to update these Terms at any time. Material changes will be communicated via email to registered users and posted on this page. Continued use of the Platform after changes constitutes acceptance of the revised Terms.

You must be at least 18 years old and legally authorized to enter into contracts in the State of New Jersey to use the Platform. Property sellers must have legal authority to sell the property they list, including proper ownership or power of attorney documentation.

By listing a property, you represent and warrant that you are the legal owner or have been duly authorized by the legal owner to sell the property.

To access certain Platform features, you must create an account with accurate, complete, and current information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You agree to notify us immediately at legal@turnkeydoor.com if you become aware of any unauthorized use of your account. TurnkeyDoor is not liable for any loss arising from unauthorized account access.

Sellers are solely responsible for the accuracy and completeness of all listing information, including but not limited to: property address, asking price, property description, square footage, number of bedrooms and bathrooms, photos, and all state-required disclosures.

All listings must comply with applicable New Jersey law, including the New Jersey Consumer Fraud Act (N.J.S.A. 56:8-1 et seq.) and all seller disclosure requirements under N.J.A.C. 13:45A-29.1. Misrepresentation of property conditions or material facts may result in removal of your listing and termination of your account.

TurnkeyDoor reserves the right to remove or suspend any listing that violates these Terms, applicable law, or that we reasonably believe contains fraudulent or misleading information.

New Jersey law requires sellers to complete certain disclosure forms, including but not limited to the Seller's Property Condition Disclosure Statement (PCDS). The Platform provides digital tools to assist in completing these disclosures, but these tools do not constitute legal advice.

Sellers are solely responsible for the accuracy and completeness of all disclosures. We strongly recommend that all disclosures be reviewed by a licensed New Jersey real estate attorney.

The Platform's disclosure tools provide general information only and should not be relied upon as legal advice. Consult a licensed attorney for guidance specific to your situation.

TurnkeyDoor charges fees based on your selected plan tier. Current pricing is displayed on the Platform during the listing creation process. Fees may include an upfront listing fee and a success-based closing fee calculated as a percentage of the final sale price.

Upfront fees are non-refundable once your listing is published to the MLS. Closing fees are payable at the time of closing through the title company or closing attorney. All fees are subject to the terms of your selected plan and may be updated from time to time with reasonable notice.

You agree that fee collection may be facilitated through our licensed partner broker, who may deduct applicable fees from closing proceeds on our behalf pursuant to a separate vendor agreement.

New Jersey custom and practice provides for a three (3) business day attorney review period following execution of a real estate purchase contract. During this period, either party's attorney may review and request modifications to the contract, or either party may cancel the contract.

TurnkeyDoor strongly recommends that all sellers and buyers retain a licensed New Jersey real estate attorney to review any contract before the attorney review period expires. The Platform's auto-generated contract templates are provided for convenience only and do not substitute for independent legal review.

Sellers using the Platform agree to offer a buyer's agent commission as specified during listing creation (typically 2.5% of the final sale price). This commission is communicated to buyer's agents through the Platform and, where applicable, through MLS cooperative compensation fields.

The buyer's agent commission is paid from seller proceeds at closing. By listing on the Platform, you authorize the closing attorney or title company to disburse the agreed buyer's agent commission from your proceeds.

The Platform facilitates showing requests between interested buyers/agents and property sellers. Sellers are responsible for confirming, declining, or rescheduling showing requests in a timely manner.

Sellers retain full control over property access at all times. TurnkeyDoor is not responsible for any incidents that occur during property showings. Sellers are encouraged to take appropriate safety precautions, including securing valuables and, where possible, having another person present during showings.

The Platform may display advertising from third-party mortgage loan originators and lending professionals. These advertisements are clearly labeled as "ADVERTISEMENT" and represent paid advertising arrangements — not referrals or endorsements by TurnkeyDoor.

TurnkeyDoor is not a mortgage lender, mortgage broker, or loan originator. You are not required to use any advertised lending partner. We encourage you to shop around and compare rates and terms from multiple lenders before making any mortgage decision.

All mortgage-related estimates displayed on the Platform (including monthly payment calculations) are approximate and for informational purposes only. Actual rates, terms, and payments may vary. Mortgage availability is subject to credit approval and applies to qualified buyers only.

You retain ownership of all content you submit to the Platform, including photos, property descriptions, and disclosure responses. By submitting content, you grant TurnkeyDoor a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute your content solely for the purpose of operating and promoting the Platform and your listing.

You represent and warrant that you own or have the right to use all content you submit, and that your content does not infringe on any third party's intellectual property rights, privacy rights, or other legal rights.

You agree not to: (a) submit false, misleading, or fraudulent information; (b) use the Platform for any unlawful purpose; (c) attempt to gain unauthorized access to any Platform systems or other user accounts; (d) interfere with the proper functioning of the Platform; (e) violate any applicable local, state, or federal law; (f) harass, threaten, or discriminate against any user; (g) scrape, crawl, or extract data from the Platform without express written permission; or (h) use automated tools to create accounts or submit listings.

All users must comply with the Federal Fair Housing Act (42 U.S.C. § 3601 et seq.) and the New Jersey Law Against Discrimination (N.J.S.A. 10:5-1 et seq.). Discrimination in the sale, rental, or advertising of housing based on any protected class is strictly prohibited.

New Jersey law prohibits housing discrimination based on 17 protected classes: race, creed, color, national origin, ancestry, marital status, civil union status, domestic partnership status, sex, gender identity or expression, affectional or sexual orientation, familial status, disability, liability for service in the Armed Forces, nationality, source of lawful income (including Section 8 vouchers), pregnancy or breastfeeding status, and genetic information.

TurnkeyDoor reserves the right to immediately remove any listing and terminate any account that violates fair housing laws. All rental listings on TurnkeyDoor accept Section 8 Housing Choice Vouchers and all lawful sources of income per N.J.S.A. 10:5-12(g)(4).

The Platform, including its design, features, code, and content created by TurnkeyDoor, is protected by copyright, trademark, and other intellectual property laws. "TurnkeyDoor" and associated logos are trademarks of TurnkeyDoor LLC.

You may not copy, modify, distribute, or create derivative works based on any part of the Platform without our express written consent.

Your use of the Platform is also governed by our Privacy Policy, available at turnkeydoor.com/privacy. By using the Platform, you consent to the collection, use, and disclosure of your information as described in the Privacy Policy.

We comply with the New Jersey Data Privacy Act (NJDPA), the California Consumer Privacy Act (CCPA), and all applicable federal privacy laws.

TurnkeyDoor provides the Platform and all associated tools on an "as-is" and "as-available" basis without warranties of any kind, express or implied. We do not guarantee the accuracy of property valuations, market data, or any third-party data displayed on the Platform.

To the maximum extent permitted by New Jersey law, TurnkeyDoor shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to: loss of profits, loss of data, property damage, or personal injury.

Our total aggregate liability for all claims arising from your use of the Platform shall not exceed the total fees you have paid to TurnkeyDoor in the twelve (12) months preceding the claim.

You agree to indemnify, defend, and hold harmless TurnkeyDoor LLC, its members, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any law or regulation; or (d) any content you submit through the Platform.

You may close your account at any time by contacting us at legal@turnkeydoor.com. We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any conduct we deem harmful to the Platform or its users.

Upon termination, your active MLS listings will be withdrawn within five (5) business days. Any pending transactions at the time of termination will be handled in accordance with applicable contract terms and New Jersey law. Termination does not relieve you of any outstanding fee obligations.

Governing Law and Forum. These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey. Any dispute arising from these Terms or your use of the Platform shall be resolved in the courts of Bergen County, New Jersey, or the U.S. District Court for the District of New Jersey.

Commercial Users (Landlords, Sellers, Agents). Disputes arising from commercial use of the Platform shall first be addressed through good-faith negotiation. If the dispute cannot be resolved informally within thirty (30) days, it shall be submitted to binding arbitration in Bergen County, New Jersey, under the rules of the American Arbitration Association. Arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action.

Consumer Users (Tenants). If you use the Platform as a tenant for personal, family, or household purposes, you retain all rights available to you under New Jersey consumer protection statutes, including the right to bring individual or class claims in court. The class action waiver in the preceding paragraph applies to commercial users only. Tenants may file complaints with the NJ Division of Consumer Affairs (1-800-242-5846) or the NJ Division on Civil Rights (1-833-NJDCR-4U).

Governing Law. These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey.

Preservation of NJ Consumer Rights. Nothing in these Terms shall be construed to limit, waive, or otherwise affect any right or remedy available to a consumer under the New Jersey Consumer Fraud Act (N.J.S.A. 56:8-1 et seq.) or the Truth-in-Consumer Contract Warranty and Notice Act (N.J.S.A. 56:12-14 et seq.). All rights provided by those statutes are expressly preserved.

Severability. If any provision of these Terms is found to be unenforceable under New Jersey law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

Waiver. Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

Entire Agreement. These Terms, together with our Privacy Policy and any plan-specific terms agreed upon during listing creation or subscription enrollment, constitute the entire agreement between you and TurnkeyDoor.
